Delhi HC quashes defamation case against Samir Modi over 2024 board meeting remarks

New Delhi: The Delhi High Court on Monday quashed the defamation case filed by independent directors Nirmala Bagri and Atul Kumar Gupta against former Godfrey Phillips India managing director Samir K. Modi. Modi claimed that the former’s public statement about the alleged physical assault against him at the board meeting in May 2024 had seriously damaged their reputation.

Justice Swarana Kanta Sharma said Modi cannot be said to have made or spread any false or defamatory allegations against the duo as a simple reading of the news articles makes it clear that the portion attributed to Modi was not to Bagri and Gupta but to his mother Bina Modi, the chairman and managing director of Godfrey Phillips.

It was stated that the only part of the news about which Bagri and Gupta complained was a single line stating that the other board members present were parties to the attack, and that this line was an exact copy of the claim made by Modi in his complaint to the police.

This line was not an independent statement from Modi to news reporters, but a copy of his own accusation to the police.that crThe judge said it was an imaginary law.

The apex court said the trial court orders directing the issuance of summons to Modi were not legally acceptable and were therefore set aside and the consequential proceedings arising therefrom were also quashed.

Modi had alleged that he was stopped and physically assaulted by his mother’s personal security guard during the board meeting in May 2024, resulting in a broken finger. He later said in an interview that board members staged an attack to prevent him from attending the meeting. Bagri and Gupta had later accused Modi of defaming them by openly claiming that they had consented to the attack on him.
