The Department of Homeland Security on Sunday criticized a plea deal for an outlawed transgender man who admitted to sexually assaulting a 14-year-old boy in New York, raising new questions about a case that will not result in additional prison time.
DHS criticized the Manhattan District Attorney’s Office following reports that Nicol Alexandra Contreras-Suarez, a 31-year-old Colombian citizen, could receive a six-month sentence for time served after pleading guilty in the case.
DHS wrote in “The Manhattan District Attorney’s Office offered ‘Nicol Alexandra’ Contreras-Suarez a crazy SIX-MONTH plea deal in exchange for admitting that he followed a 14-year-old boy into a bathroom and RAPED her in February 2025.
DHS continued: “Contreras-Suarez was brought into our country by the Biden administration and was released again after her arrest on charges of armed robbery, assault with a dangerous weapon, and prostitution.” “This pervert should NEVER have been in our country. Last week, Contreras-Suarez pleaded guilty to second-degree rape after initially being charged with first-degree rape of a child under 17 and stalking.
Contreras-Suarez was promised a six-month sentence by a Manhattan Supreme Court judge on Tuesday. However, according to the New York Post, the defendant is expected to be compensated for the time he spent in prison and be released from custody after the sentencing on April 27, unless federal immigration authorities intervene.
“We expect the defendant to remain in custody and be deported after being convicted of the serious crime,” a spokesperson for the Prosecutor’s Office told the outlet. he said.

Contreras-Suarez was arrested by U.S. Customs and Border Protection in March 2023 after illegally crossing the border near San Ysidro, California, according to DHS.
Following the New York City arrest, then-DHS Deputy Secretary Tricia McLaughlin criticized the release, saying the suspect should not have been allowed to remain in the country and blaming federal immigration and local asylum policies.
Immigration and Customs Enforcement filed a detainer against Contreras-Suarez following the arrest in Manhattan.

McLaughlin said at the time that ICE would try to make sure the defendant could not continue to pose a threat to the public.
