The House Judiciary Committee on Tuesday released internal Border Patrol documents showing that a Venezuelan immigrant accused of killing Loyola University student Sheridan Gorman was flagged as a flight risk and did not have a valid asylum claim before being released to the United States in 2023.
Jose Medina-Medina, 25, is accused of fatally shooting 18-year-old Gorman in Chicago in March.
Fox News Digital previously reported that Venezuelan illegal immigrant Medina-Medina was captured at the southern border in 2023 and later released into the country under the Biden administration.
House Republicans said in a post about X that the documents showed authorities released an immigrant they described as dangerous despite warning signs.

“The person is a Venezuelan citizen by birth and is a Venezuelan citizen,” the document states. “The individual is an immigrant who is in the United States illegally, does not hold any immigration documents, and has not filed or had anyone else file a petition on his or her behalf. The individual has close family ties or roots in this country, but is likely to flee.”
Additional records indicate the individual did not have a valid U.S. address or identification and was unable to provide a verifiable point of contact.
The documents also detail the circumstances of Medina-Medina’s capture at the border.

“A Border Patrol Agent encountered the suspect in the El Paso Border Patrol Sector area of responsibility,” the document said. “A Border Patrol Agent determined that this individual entered the United States illegally from Mexico other than at the time and place designated by the Secretary of the United States Department of Homeland Security.
“Upon determination that the individual was an undocumented immigrant who entered the United States illegally, the individual was arrested and transported to the Central Processing Center (CPC) in El Paso, Texas, for further processing. [redacted] “The individual was asked and answered whether they feared harm or persecution if repatriated to their home country,” the document continued.
Despite these findings, documents show that he was processed for a Notice to Appear under the Immigration and Nationality Act “Due to lack of space” and was released.

Federal prosecutors charged Medina-Medina on April 2 with unlawful possession of a firearm, which carries a maximum sentence of 10 years in prison. In addition to the federal charge, he also faces state charges of murder, attempted murder, aggravated assault and unlawful possession of a weapon.
Prosecutors said Gorman spotted Medina-Medina near a lighthouse with friends at the Rogers Park pier in the early morning hours of March 19 and warned others. Medina-Medina chased the group and shot Gorman in the upper back as he fled, authorities said.

In a statement released after the accusations, the Gorman family said: “Sheridan was a real person; he had a future, a family, and a life full of promise.”
