Judge dismisses James Comey and Letitia James indictments over ‘unlawful’ prosecutor appointment

A federal judge in Eastern Virginia on Monday dismissed criminal charges against former FBI Director James Comey and New York Attorney General Letitia James, ruling that interim U.S. attorney Lindsey Halligan, who filed both indictments, was invalidly appointed.

Senior U.S. District Judge Cameron Currie ruled in both cases that Halligan, President Donald Trump’s former personal attorney, was appointed interim federal prosecutor in violation of the Constitution’s Appointments Clause.

“Both cases were dismissed ‘without prejudice,’ potentially allowing for re-filing at a later date.”

“I am encouraged by today’s victory and grateful for the prayers and support I have received from across the country,” James said in a statement following his dismissal. he said. “I remain fearless in the face of these baseless accusations as I continue to fight for New Yorkers every day.”
