Sandie Peggie tribunal judgement to be amended in fake quote row

A court decision of a nurse who was repeatedly suspended from her job over trans women’s use of single-gender changing rooms has been changed following complaints that a quote used in the decision was “fabricated”.
An employment tribunal on Monday outlined four ways NHS Fife harassed Sandie Peggie but rejected all other allegations.
Miss Peggie, trans woman Dr. He filed the lawsuit after he was suspended due to a dispute with Beth Upton.
Campaigners claimed the 312-page judgment in the Peggie case contained a “fabricated” quote from another case.
The court has now published a “certificate of correction” He stated that there were “writing error(s), mistake(s) or omission(s).” This does not change the overall decision.
The case received international attention because it concerned whether transgender women (biological men who identify as women) could use women-only locker rooms.
Following the ruling, campaigner Maya Forstater, one of Ms Peggie’s best-known supporters, said references in the ruling to her case against the European Center for Global Development were “completely fabricated”.
The decision in Ms Forstater’s case highlighted that the Equality Act did not create a “hierarchy of protected characteristics”, Peggie said.
Ms Forstater posted a screenshot of the text from the court on social media platform X and said: “One of the many mistakes in the Sandie Peggie decision.
“This ‘quote’ from my judgment does not come from my judgment. It is completely fabricated.”
A new quote from the Forstater case has now been added.
The revised version of the Peggie judgment reads: “We consider that this quotation supports the proposition that the Equality Act 2010 does not create a hierarchy of protected characteristics.”
Under employment law, a judge may “correct any typographical error or other accidental slip or omission at any time” and publish an amended version.
Ms Forstater said she was puzzled by how the error occurred and wanted an explanation.
He added that other errors were also identified in the decision and that they “seriously undermine people’s confidence in the legal process”.

At the Victoria Hospital in Kirkcaldy, the women’s changing room was occupied by Dr, a biological male who identifies as female. He refused to share with Upton and was suspended from work in early 2024.
This came to an end after an encounter in the dressing room on Christmas Eve 2023, when Miss Peggie told Dr Upton she was uncomfortable with the doctor being there.
He also referenced rapist Isla Bryson, who changed gender while awaiting trial.
After being convicted, Bryson was initially sent to a women’s prison, but was later transferred to a men’s prison.
The rapist was later sentenced to eight years in prison.
Ms Peggie claimed her experiences amounted to harassment and, citing the Equality Act 2010, the medical board and Dr. He took legal action against Upton.
On Monday, the 312-page decision found in his favor on four counts, but both the medical board and Dr. Upton has denied other allegations against her.
Some of Ms Peggie’s comments towards Dr Upton were found to “constitute harassment” and breach the medical board’s bullying and harassment policy.
A separate hearing will be held at a later date to decide on a “settlement” that could result in compensation being paid to Ms Peggie.
But the decision was criticized by some campaigners, including the Sex Matters group of which Ms Forstater is chief executive.
