Gurugram rape case: Supreme Court criticises Haryana Police’s insensitive handling of four-year-old child’s rape case

The Supreme Court on Wednesday (March 25, 2026) condemned the Haryana Police and its child welfare committee for their insensitive handling of the rape case of a four-year-old child.

The court was hearing the parents’ petition in which they alleged inaction of Gurugram police. The court on March 23, 2026, issued notices to the Government of Haryana, its DGP and others seeking a CBI or SIT inquiry into the rape of a four-year-old girl in Gurugram.

“It is shameful that the Haryana Police summoned the rape victim to the police station instead of visiting her,” the Supreme Court said on Wednesday (March 25) and constituted a three-member Special Investigation Team (SIT) comprising women IPS officers of the Haryana cadre to investigate the rape case.

The court also directed the Haryana government to inform the SIT immediately. It also directed Gurugram Police to submit case records by March 26, 2026.

The Supreme Court issued show notices to Gurugram Police officials for their shoddy investigation into the case and asked why action should not be taken against them.

The court also issued show-cause notices to the members of the Gurugram Child Welfare Committee asking why they should not be removed.

He also directed the Gurugram District Magistrate to give the rape case to a senior woman judicial officer heading the POCSO court.

After noting the blatant insensitivity, sheer recklessness and irresponsible behavior of the said officials, the court ordered all officers of the Gurugram police, including the Commissioner of Police, to be disassociated from the investigation and ordered formation of a Special Investigation Team (SIT) comprising three senior IPS rank women officers to take over the investigation.

“If the state respects the law, the police need to be transferred immediately. As soon as we become aware of it, you start arresting people. Have they read any naked action? This case is the peak of this insensitivity. The incident took place on February 2, and on February 5, the CWC had a phone conversation with the victim’s parents. If they had respect for the victim, they should have gone to the victim’s house, not called them to the office. At the hearing, the court stated that those who went to the child’s house are now arrested on charges of corruption.

On March 20, the Court agreed to hear the plea seeking a CBI or SIT investigation into the rape of a 3-year-old girl in Gurugram. The court had taken note of senior advocate Mukul Rohatgi’s urgent mention and posted the matter for hearing on March 23, 2026.

The senior lawyer told the court that the police did nothing despite the girl giving a statement to the magistrate detailing the horrific incident.

“No arrests were made. The site was not secured. There is no CCTV. [footage] taken. House servants are involved,” Mr. Rohatgi had noted.

The CJI initially asked the petitioners to move the Supreme Court. However, the senior lawyer said the relevant High Court would be in Chandigarh, claiming that the victim’s father was working in Gurugram and “a message should come from the highest court of the country” in this “horrible case”.
