High Court dismisses Peru’s petition for ‘Pisco’ rights

A bench of justices C Hari Shankar and Om Prakash Shukla upheld the decision given by the single judge in July and ruled that Peru can use the term ‘Peruvian Pisco’ but cannot claim exclusive right over ‘Pisco’.

The court said that both the countries have a long-standing history of using the brand ‘Pisco’ in alcoholic beverages and neither country can claim exclusivity on its own in India.
“Both Peru and Chile have established the use of the brand ‘Pisco’ for alcoholic beverages. Chapter 9A [of Geographical Indications of Goods (Registration and Protection) Act, 1999] “It is an obstacle to granting Peru an independent Pisco GI (geographical indication).”
This is the first case in which the two countries have challenged geographical indication rights before an Indian court.
