New green card rules for married couples strengthen immigration officials’ powers amid backlog; here’s how

An updated policy guidance has been published by US Citizenship and Immigration Services (USCIS), focused on how to evaluate the family -based migrant visa petitions commonly used by married couples looking for green cards.

In a press release published on August 1, 2025, USCIS said, “Family -based immigrant visa petitions with fraudulent, meaningless or otherwise not wise, were safely strengthened to the status of a family -based legal residence (LDR) and the ways to weaken the family unity in the United States.” He said.

Green Card Update Strengthens USCIS

The Green Card update states that the approval of a family -based petition does not give legal migration status on its own. According to USCIS, if a beneficiary is found to be otherwise removable according to US immigration laws, it may give a notification in the removal transactions.

The update aims to clarify the existing procedures and to improve the ability of the agency to evaluate the validity of marriage -based and other family migration petitions that spouses or close relatives apply for legal permanent residence. Guidance explains the criteria of conformity, documentation requirements, interview procedures, how the USCIS looks with cases with more than one or relevant petitions, and when the petitions can be referred to other state institutions.
