Labour MP Jess Asato sues Elon Musk’s xAI for damages saying its Grok chatbot tool was used to create fake bikini pictures of her

A Labor MP has filed a compensation claim against Elon Musk’s xAI, saying its Grok chatbot tool was used to create fake bikini photos.
Jess Asato, MP for Lowestoft in Suffolk, previously said it was a ‘violation’ to see the tech billionaire’s AI chatbot being used to create images of him without his consent.
These included not only photographs of Ms. Asato in a bikini, but also disturbing images of her being chloroformed and being primed for sexual assault.
And since taking legal action, Ms. Asato has seen other images produced by the AI she created.
In a claim submitted to the Supreme Court, Ms Asato accused xAI, a company owned by Musk, which also owns X, of violating data protection laws and misusing private information, such as using people’s images without their consent.
Speaking to BBC Breakfast, Ms Asato said: ‘It is important that we use existing law to hold these tech companies to account. ‘If someone causes harm through a product like Grok, that needs to be compensated in some way.’
The MP added that he wanted to win the case to show that tech companies “cannot act with impunity” and must have “safeguards” built into their products to prevent people’s images being used without their consent.
He also asked for all victims whose images were manipulated by Grok to come forward.

The Prime Minister expressed his support for Ms. Asato today.
Speaking in York, the Prime Minister told reporters: ‘Jess Asato is absolutely right in her action. In his particular case, disgusting images were created by Grok.
‘I’m really glad we covered Grok a few months ago, because that’s the fight we had to fight, taking on some of these platform providers. [and] Some of these disgusting images are truly disgusting. We won this.
‘But Jess is right, he is a parliamentarian. I stand behind his action 100 percent.
‘When it comes to the disgusting images at Grok, we are taking on Grok and fighting because that’s who we are as a country.’
Ms. Asato’s lawsuit follows a similar lawsuit filed in New York by Ashley St Clair, the mother of one of Musk’s children, who also alleged that the sexually explicit images, including an image of a minor, were created by Grok.
Advocate Ravi Naik, representing Ms. Asato, said: Financial Times: ‘At the heart of this case is a single principle: Developers need to answer for the way they design and distribute their tools.
‘Our situation is… an image of you, designed to look like you and [whose] The main purpose should be your image, whether to humiliate you or have you represented in different circumstances. xAI says otherwise.’
Ms Asato’s lawsuit comes after Ashley St Clair (pictured) filed a similar lawsuit in New York. Ashley St Clair alleged that sexually explicit images were created by Grok, including an image of her as an underage.
Recalling the time when the AI images were created, Ms Asato told Breakfast that the experience left her feeling ‘dehumanised’ and ‘humiliated’.
He said: ‘As an MP I campaign against violence against women and girls and when we heard that Grok was being used to create these horrific sexualized images.
‘I opposed it and then I became a victim too.
‘I certainly wasn’t the worst victim affected, but it made me feel dehumanized, it made me feel humiliated, it was something that made me feel like my consent had been taken away.
‘In my case [Musk] I said that I did not want to be made to wear a bikini and reshared a photo of me laughing at what happened to us.’
Ms Asato also revealed that other AI-generated images of her have been created since she took legal action.
The UK government has previously threatened legal action against X, formerly Twitter, after Grok was used to produce sexualized images of real women and, in some cases, children. Meanwhile, Ofcom launched a separate investigation.
X initially said it would change its rules so that only paying customers could produce such images; It was a move strongly condemned by Sir Keir Starmer as ‘appalling’.
Just a few days later, X U-turned and announced that Grok would stop editing images of real people to show them in revealing clothing.

Meanwhile, Grok and other AI platforms faced criticism after falsely accusing two Hampshire Police officers of being involved in the arrest of Henry Nowak in December 2025.
Christi Hill, who has been a police officer for 12 years, said she was forced to flee to safety after many posts on X called for her and a misidentified male officer to be followed.
The posts called for the couple to be arrested and, in some cases, subjected to violence.
Sir Keir also accused Elon Musk of ‘trying to incite division’ in Britain following Henry’s murder.
He said: ‘We need to reveal who we are as a country because Musk has been intervening in our politics again over the last few days, trying to incite division. ‘That’s not who we are in Britain.’
Sir Keir continued: ‘We also need to reveal who we are as a country because Musk has been intervening in our politics again in the last few days, trying to provoke division. That’s not who we are in Britain.
‘In England we are reasonable and tolerant people. ‘When we encounter a horrific case like Henry’s, Henry Nowak’s, we react calmly, just as his family did.’
The Daily Mail has approached xAI for a comment.
