A New York state court judge on Monday blocked prosecutors in the case from using some of the evidence in Luigi Mangione’s backpack when he was detained by police at a McDonald’s in Pennsylvania immediately after his murder. UnitedHealthcare CEO Brian Thompson is in Manhattan.

Manhattan Supreme Court Judge Gregory Carro said that “the evidence found during the search of the backpack at McDonald’s should have been suppressed” because the backpack was not under adequate control when Altoona police detained Mangione. [loaded ammunition] magazine, mobile phone, passport, wallet and computer chip.”

However, Carro ruled that the 3D-printed gun suspected of being used in Thompson’s murder and the diary in the backpack, which was later inventoried by police at headquarters, could be used as evidence.

Mangione is accused of fatally shooting Thompson, 50, on a midtown Manhattan street in December 2024 while the insurance company CEO was attending an investors event for UnitedHealthcare’s parent company, UnitedHealth Group.
