NCLT tells New Tirupur Area Development Corporation, IL&FS to approach appropriate forums on debt dispute

National Company Legal Court (NCLT), Mumbai, New Tirupur Area Development Corporation Limited (NTADCL) and shareholder infrastructure Lassing & Financial Services Ltd. (IL & FS) ‘s debt repayment to approach the appropriate forums on the disputes.

In 1995, NTADCL was included as a special purpose tool and public service to improve the drinking water and sewage infrastructure in Tiruppur through an integrated water supply and sewage project. In general, the Tamil Nadu government has a 38.32% share of NTADCL, while IL & FS is 25.88%.

Total project cost 1,023 Crore. 613.8 Crore debt was regulated from various banks and financial institutions and IDBI Bank Leading Credit Institution. From this, IL & FS collected 90 Crore from the US International Development Agency (USAID). On this loan, IL & FS deducted approximately 41.24 Crore and paid 48.76 CRORE to NTADCL.

Due to the worsening financial position of NTADCL, an institutional debt restructuring (CDR) plan was implemented on 29 March 2012, some of which infused the Tamil Nadu government to NTADCL 150 Crore and also provided advanced pricing. According to the restructuring plan, 30% of IL & FS debt was transformed into self -esteem. After the implementation of the CDR, the senior loan to be repaid by NTADCL was 120.27 Crore. NTADCL had to pay back from April 2013 to March 2026.

In his objection before NCLT, NTADCL, according to the amount he received from IL & FS, was already paid more than 249,92 crore from NTADCL to IL & FS and sought an order to evacuate other obligations within the scope of CDR.

He also claimed that there was a fraud applied by IL & FS in credit payment.

IL & FS said that since December 1, 2022, NTADCL has unilaterally stopped the repayment of main and interest amounts. As of December 30, 2022, IL & FS demanded the amount of 52.92 Crore in total principal. NTADCL asked for the recovery of what is called “delayed quantity, and asked for the rest of the total unpaid main debt to be restored.

IL & FS said that NTADCL has always accepted and accepted its indebtedness in terms of USAID parts worth 90 Crore.

Regarding the tax of the accusations made by NTADCL in the amount of 41.24 Crore Crore by IL & FS, the agreement on these charges and the controversial facts related to IL & FS works require investigation. Accordingly, NTADCL may approach SFIO about the accusations for the investigation.

He added that the instructions sought by IL & FS are in the nature of the rescue operations and that only civil courts are included in the jurisdiction.
