Palestine Action legal challenge over group’s terror ban allowed to go ahead

The Court of Appeal rejected the Home Office’s appeal, ruling that the co-founder of Palestine Action could appeal to the Supreme Court against the government over its banning of the group as a terrorist organisation.
In her summary of the Court of Appeal’s decision dismissing the Home Office’s appeal, Lady Chief Justice Baroness Carr said: “An application for disbarment with a right of appeal to the POAC (Prohibited Organizations Appeal Commission) was not intended to be a means of appealing the initial decision.”
He added: “A judicial review would be a quicker way to challenge the decision banning Palestine Action than applying to lift the ban.
“Judicial review will enable the Supreme Court to make an authoritative decision on whether it was lawful to ban Palestine Action. This decision can then be relied upon in criminal courts that bring criminal charges against any person arrested in connection with his support for Palestine Action.”
