“An interlocutory appeal can eliminate the need for these burdens with almost no downside. Whichever view of the law is correct – Franchitti’s or Cognizant’s – the benefits of knowing it now are enormous. If Franchitti’s view is correct, knowing this now can make it easier to resolve the case through compromise.
