Radio 2 presenter Scott Mills is suing the BBC after it sacked him over sexual misconduct allegations, The Mail on Sunday has revealed.

Mills, 53, believes he was unfairly dismissed after new information emerged about historic allegations of serious sexual offenses against a teenager in March.

The legal team at London-based firm Level Law has been corresponding with the company and its employers for weeks for 28 years.

Friends of Mills believe he was used as a ‘scapegoat’ by the BBC’s then director general, Tim Davie, who adopted a zero-tolerance approach following a series of recent scandals involving Huw Edwards, Gregg Wallace and Jermaine Jenas.

One said: ‘Scott is devastated but also angry. Because of a police investigation that was aborted years ago, he lost not only his job, but also something he loved. They have lawyers. They are the attackers and are determined to get justice for him.

‘Scott feels he has been wronged and there is a view that by sacking him the BBC are using him as a scapegoat to show that they are cleansing themselves of past scandals with the likes of Huw Edwards and Jimmy Savile.

‘Actually, Scott wants to clear his name. He wants to come out and tell his story, but he can’t until the legal battle is over.

‘Getting fired broke him. His mental health is in a very fragile state and, according to him and his legal team, this feels completely unfair, which is why they are fighting the BBC. There is clearly an unfair dismissal claim here. Decisions like this ruin lives, and this one ruined Scott’s.’

The BBC has fired Mills, who was due to host last night’s Eurovision broadcast, after saying new information had emerged about a police investigation into allegations of historic sexual offences.

Mills was questioned in 2018 about allegations dating back to 1997-2000, and the case was dropped the following year due to lack of evidence.

It later emerged that the BBC was aware of this situation; However, the current administration is said to be unaware of the age of the alleged victim.

In the days before his sacking, a man is thought to have approached BBC bosses – reportedly after watching Channel 5’s Power: The Downfall of Huw Edwards – to inform them that the teenager at the center of the allegations was under 16.

Mr Davie told staff that new information had come to light ‘fairly recently’, making the decision the broadcaster had to make ‘very clearly’.

Mills also said in a statement that he fully cooperated with the investigation at the time.

Mills, who previously presented the Radio 1 breakfast show, is supported by husband Sam Vaughan at their home in Rickmansworth, Hertfordshire.

He has been keeping a low profile since the last day of his radio show in March but was spotted walking his dog.
