The attorney for White House chief of staff Susie Wiles in 2023 is pushing back against allegations that the Biden-era FBI agreed to allow her to record a conversation with her client without her knowledge, according to a report.
“If I had pulled a stunt like this, I would not and should not be licensed to practice law,” the unidentified lawyer said, according to Axios. “I was just as shocked as Susie.”
The rejection comes as scrutiny intensifies over the FBI’s use of subpoenas and investigative tools during Special Counsel Jack Smith’s investigations into Trump ahead of President Donald Trump’s re-election in 2024.
Reuters first reported the subpoenas on Wednesday, reporting that the Biden FBI had subpoenaed phone records of Wiles and current FBI Director Kash Patel from 2022 and 2023, when both were private citizens. Smith was investigating allegations that Trump worked to overturn the 2020 election and that he handled classified documents at his Mar-a-Lago, Florida, resort.

At least 10 FBI employees were fired Wednesday over the matter, Fox News Digital previously learned.
Amid the disclosures, two FBI officials said FBI agents recorded a phone call between Wiles and his lawyer in 2023. Authorities claimed that Wiles’ lawyer was aware that the conversation was being recorded and consented to it, but Wiles was not informed.
The attorney, whose name has not been released publicly, backtracked, saying he “categorically denies allowing his client to be recorded by the FBI.” According to Axios reporter Marc Caputo.
In his article to X, Caputo wrote that Wiles “believed him and the Biden-era FBI may have lied about this.”

“It is outrageous and deeply troubling that previous FBI leadership secretly subpoenaed my own phone records, along with those of current White House chief of staff Susie Wiles, using flimsy pretexts and buried the entire process in forbidden case files designed to evade all surveillance,” he said in a statement obtained by Fox News Digital.
