Republic man accused of shooting woman with AK-47 in home invasion over inheritance
BATTLEFIELD, Mo. — A Republic man faces multiple felony charges after investigators say he broke into a home, attacked a teenager and shot a woman with an AK-47-style rifle on New Year’s Day.
According to the probable cause affidavit, Timothy Kirby is charged with first-degree assault; serious bodily injury, armed criminal action, second-degree assault, first-degree burglary and two counts of armed criminal action in Greene County Circuit Court.
At approximately 3:51 p.m., Jan. 1, Battlefield police responded to reports of a shooting at a home in Battlefield; where a teenager told investigators two masked men entered the home demanding money.
According to the statement, Kirby and another suspect, who is not named in the document, allegedly attacked the child before shooting his grandmother.
The statement alleges that Kirby illegally broke into a home to steal money and jewelry after learning that one of the victims had recently received a large inheritance.
Witnesses told police that Kirby attacked the child using the butt of an AK-47-style rifle, then pointed the gun at the woman and fired, hitting her and causing serious injuries.
The statement stated that the crime occurred in a densely populated neighborhood and that the gunshots posed an “immediate and extreme danger” to nearby residents.
After the conflict, Kirby allegedly fled the scene with a rifle in his hand. He was later seen throwing the gun at another Battlefield residence, where it caused property damage.
Investigators recovered the firearm and a matching 7.62 mm bullet casing, according to the statement.
When Kirby was arrested, deputies said he had two ski masks in his pocket.
He is being held without bail at the Greene County Jail.
