Kerala High Court orders appointment on compassionate grounds, despite criminal antecedents

The Supreme Court of Kerala directed the state government to appoint a person in the police department as a driving in the police department for compassionate reasons despite its priority.
In the episode, his mother, who worked as a part -time vacuum cleaner, died when he was at his service. A. Muhammad Mustak and Justice Johnson John said that there is no relevant connection between the crimes he committed and the nature of the task in question. After the death of his mother in 2017, he was presented to the police officer (driver) under the scheme of compassion.
The government rejected its appointment and stated that the attack, unauthorized entry, public consumption of alcohol in the public, and then participated in several criminal cases, including a marriage dispute that was solved later. The claim that he could not disclose them in the verification form was stated as another reason to reject his employment.
Based on what he calls ‘Nexus test’, the court said that there should be any connection between past crimes and the task he would participate in. In addition, considering the social and economic backgrounds and the obstacles it faces in life, it should be seen that access to public employment can be rejected. The court said that small tours should not close the door permanently for reform and ordered it to be appointed within four weeks.
