Trump admin threatens to cut federal funding from Kansas City schools

The Trump administration said Tuesday it would take enforcement action that could include withholding federal funds from the Kansas City, Kansas, Public Schools over policies the administration said prevented staff from disclosing a transgender student’s gender identity to parents.

Kansas City, Kansas Public Schools’ policy of not disclosing a student’s transgender status to their parents violates the Family Educational Rights and Privacy Act, the Department of Education said.

The agency announced it was partnering with the Department of Justice to take “appropriate enforcement actions,” including valid judicial proceedings and potential loss of federal funding.

“Kansas City Kansas Public Schools’ continued efforts to evade FERPA, conceal their true policies, and deny parents lawful access to their children’s education records represent a serious and willful violation of federal law,” said Frank Miller, Director of the Education Department’s Office of Student Privacy Policy.

“A strong and coordinated enforcement partnership between the Department of Education and the Department of Justice will ensure that districts are held accountable and the rights of parents are fully respected,” he added.

According to the government, the district’s policy confirms that school personnel “shall not disclose information that may reveal a student’s transgender status or gender nonconforming presentation to others, including parents.”

“Despite the Department’s proposed Resolution Agreement outlining specific actions the District must take to correct FERPA violations, the District continues to ignore federal parental rights law,” the Department of Education said.

Earlier this year, the Department of Education said policies regarding transgender students in four Kansas school districts, including Kansas City and Kansas Public Schools, violated federal law.

President Donald Trump has issued an executive order aimed at banning transgender women and girls from competing in girls’ and women’s sports. The U.S. Supreme Court on Tuesday ruled that states can ban transgender women and girls from girls’ and women’s sports, upholding the Idaho and West Virginia law and not requiring states without such bans to adopt them.
