Trump and Rubio move to dismantle ICC with sanctions and visa bans

At the core of the American project has always been a fierce challenge to distant powers, a stubborn opposition to those who seek to undermine our right to self-government or to impose their will on a people determined to determine their own destiny.

This spirit not only brought America into existence, but is essential to preserving our nation’s sovereignty into the future.

America once again challenged those who would undermine our right to self-government, Secretary of State Marco Rubio said on July 13. announced He said the Trump administration would “disband” the International Criminal Court and teach them “the full meaning of American determination.”

This would include diplomatic pressure on nations that partner with American law enforcement or our military and enjoy the benefits of our protection, coordination with allies to join us in rejecting the authority of the International Criminal Court (ICC), sanctions against the ICC and its affiliates, and visa bans on ICC personnel. I have pushed for similar policies to be legally implemented, including the “ICC Out of NYC Act” legislation that prohibits the use, rental, or occupation of United Nations properties in New York City by ICC representatives or employees.

But the ICC remains convinced of its power to pierce the veil of American sovereignty and enforce the law against American citizens, soldiers, and public officials. A global court that seeks to exercise ultimate authority above and beyond the authority of any nation state poses a direct and serious threat to the continued sovereignty of the United States that can no longer be tolerated.

As Americans, we wholeheartedly reject the idea that a supranational entity, created specifically by a law never ratified by our country, has legitimate jurisdiction over our citizens and leaders. The US Constitution is our law and our guide, no other.

To lose the legal authority of the United States government to an unaccountable transnational organization would be to betray the American people and to abdicate our right to self-government.

An active and emboldened ICC means that American sovereignty is subject to the whims of a globalist entity run by people who have never stood in elections before the American people, have never represented America’s interests, and have never sworn allegiance to the American Constitution. No self-respecting nation, especially one founded in rebellion against the tyranny of a distant power, can allow unelected globalists to wield unchecked force against its citizens, soldiers, and leaders.

The United States has been trying to impose limits on the ICC for decades; Presidents of both parties warn of the threat the court poses to American sovereignty. From Bill Clinton to George W. Bush to Barack Obama, no president has been willing to ratify the Rome Statute, which would place American sovereignty in the hands of globalist bureaucrats empowered to whitewash their political grievances in the language of unenforceable international law.

But despite the reluctance of past presidents to fully legitimize the court, none have been willing to take decisive action to prevent the serious violations of sovereignty that the ICC is capable of committing today. Half-measures are not enough in the fight to defend America’s sovereignty.

As Americans, we wholeheartedly reject the idea that a supranational entity, created specifically by a law never ratified by our country, has legitimate jurisdiction over our citizens and leaders. The US Constitution is our law and our guide, no other.

Only President Donald Trump is proving bold enough to take decisive action against the ICC’s capabilities, which is necessary to ensure that American citizens and soldiers are never subject to the courts, and thus America’s elected leaders are never threatened with arrest for acting in our country’s national interest.

No nation is truly independent if it allows an unaccountable court to sit above it and claim jurisdiction over its people and elected officials. Meeker countries may be happy to cede veto power over their foreign and domestic policies to an unaccountable supranational body, but such a blatant departure from national self-government is completely alien to the American tradition, mind, and spirit.

This is why the Trump administration is right to take on the ICC and ensure that it never has the capacity to threaten the United States and its people.
