Trump DOJ urged to appeal dismissal of Ábrego García smuggling charges

The alleged criminal, Salvadoran Kilmar Armando Ábrego García, blatantly disregarded our laws by entering the United States illegally. He continued to flout our laws by engaging in alien smuggling and conspiring to commit alien smuggling, according to an indictment handed down by the federal grand jury in Nashville. On Friday, Obama-nominated District Judge Waverly Crenshaw stunningly dismissed the charges on the absurd basis of vengeful prosecution. This decision is outrageous, and the Trump Justice Department should immediately appeal it to the U.S. Court of Appeals for the Sixth Circuit.

Illegal immigration is not always acceptable. But some illegal immigrants represent the worst of the worst. They don’t come here to work in restaurants, for example, to provide a better life for their families. Instead, they come here to continue their gang activities, traffic drugs, and terrorize communities. Laughably portrayed by leftists as the “father of Maryland,” Ábrego García represents one of the worst of the worst. There is strong evidence that he was a member of MS-13, a Latin America-based terrorist gang responsible for numerous acts of barbarism. His wife requested a protection order against him due to allegations of domestic violence. He allegedly brought thousands of illegal immigrants into our country in hundreds of trips. Now he’s free, thanks to another radical Obama judge.

Ábrego García rose to fame when news emerged that the federal government had mistakenly deported him to El Salvador after an immigration judge ruled him unfit to return there because of the alleged danger from gangs. It later emerged that Ábrego García had allegedly killed the mother of a rival gang member, and the gang that supposedly posed a threat to him could no longer live in El Salvador; because heroic President Nayib Bukele, unlike the Obama judges, keeps violent gang members behind bars. After lengthy litigation and negotiations, the government of El Salvador extradited Ábrego García to the United States last year to face federal charges of alien smuggling and conspiracy to commit alien smuggling, following an indictment by a Nashville federal grand jury.

The indictment alleged that Ábrego García was part of a major human trafficking ring that was responsible for, among other horrors, a tractor trailer that overturned en route to the United States, killing approximately 50 illegal immigrants. His collaborators claimed, among other things, that Ábrego García abused some of the kidnapped women and brought firearms and narcotics along with his human cargo. It was claimed that Ábrego García did not have any standards regarding smuggling. He was allegedly transporting women and children with members of gangs like MS-13 and other violent groups, with no regard for the safety of the women or children who became targets of these monsters (or the Americans upon arrival).

However, this evidence did not satisfy Obama Judge Crenshaw. He seemed willing to accept that there was sufficient evidence that Ábrego García had engaged in illegal conduct; but he waved a magic wand and decided that the prosecution was somehow vindictive. It is heartening to see that judges are now concerned about revenge prosecutions. Radical D.C. Chief U.S. District Judge Jeb Boasberg, another Obama judge, raised similar issues regarding the arrest of a man on charges of setting a fire in a public park for burning a U.S. flag. Boasberg believed that even though setting fires in public parks was a federal crime, the Justice Department could only prosecute flags for burning. When President Trump was impeached four times by Democratic prosecutors for new (and bogus) legal theories, such as the ludicrous claim that a confidentiality payment made to settle a personal matter must somehow be reported for campaign financing purposes, no justice expressed concern about retaliatory prosecution. The trial of hyper-partisan Democrat Manhattan District Attorney Alvin Bragg has become a massive 34-count indictment against something (Trump) that has never been prosecuted by any jurisdiction before.

In response, the federal government prosecutes human smugglers and those who continually conspire to abduct aliens. It is true that immigration enforcement has become incredibly lax under the Biden administration; Indeed, millions of illegal immigrants poured into our then porous border. President Trump and his all-star administration fulfilled the electoral mandate he received from American voters, ending this horror show and securing the border with extraordinary speed and efficiency. Part of enforcing border security is the prosecution of those who try to violate that border by smuggling aliens. Apparently this common sense concept is too complex for Obama Judge Crenshaw to grasp. This radical judge released Ábrego García from pre-trial release conditions. This outlaw is no longer under his brother’s custody or electronic monitoring. He is free to roam the streets and do what he does best: terrorize innocent Americans.

Since President Trump was re-elected, rogue Democratic district judges, largely appointed by Obama and Biden, have done their best to thwart Trump’s agenda and the will of American voters. The Supreme Court has intervened nearly three dozen times to stop this unconscionable and illegal judicial sabotage. Federal appeals courts have ruled these radical Democratic district judges in robes dozens more times. The Sixth Circuit should join the list and reinstate the Ábrego García indictment, reversing yet another rogue decision by another rogue Obama judge. While the appeal process is ongoing, the appeals court must delay Obama Judge Crenshaw’s decision so that release conditions, especially electronic monitoring, can continue. Kilmar Armando Ábrego García is no saint, despite Democrats’ efforts to sanctify him. Ábrego García has proven to be a threat and the courts need to treat him accordingly.
