China intellectual property theft campaign threatens US national security

China’s systematic and orchestrated campaign of intellectual property theft and technological advancement poses an unprecedented threat to America’s national security and requires a comprehensive and immediate response. The United States, whose technological superiority was once indisputable, is now grappling with threats to our national security that are both insidious and far-reaching, emanating from the agenda of the Chinese Communist Party (CCP).
As the world enters an era defined by new forms of power, emerging technologies such as artificial intelligence (AI), quantum computing and hypersonic weapons are at the forefront of the US-China competition. The National Security Commission on Artificial Intelligence underlined the urgency of this technological race as early as 2021, warning that “China has the power, capability and ambition to surpass the United States as the world leader in artificial intelligence in the next decade.”
This danger arises not only from China’s relentless pursuit of American know-how and data (evidenced by high-profile cases such as Chinese citizens accused of cyberespionage against US companies) but also from the uncomfortable reality that America has significantly enabled this theft of intellectual property through investments and inadequate controls. The consequences of such actions cannot be overstated; they resonate in every aspect of national security and economic competitiveness.
While the United States was embroiled in protracted conflicts in the Middle East, the CCP pursued a “whole-of-society” approach to national revitalization. The 2017 National Intelligence Law requires all Chinese organizations and citizens to support, assist, and cooperate with government intelligence efforts; This raises concerns about the security of joint ventures and technology transfers.

It is claimed that China’s economic and military rise since joining the World Trade Organization in late 2001 is unprecedented in history in terms of speed, scale and financial gain. The purpose of this membership was to integrate China into the international economic order. China has misused its WTO membership for its own personal interests at the expense of the global international order.
When Xi Jinping took the reins of the CCP in 2012, the sweeping plan to steal America’s commercial “crown jewels” accelerated. The Ministry of State Security (MSS), China’s version of the FBI, CIA, NSA and Cybercommand, has doubled in size in the past 10 years. Just as planned by the CCP high command and enabled by the CNS, China would transform from an economic backwater to the economic superpower it is today.
For the PRC/CCP, every aspect of American innovation is a target. The scope of espionage is staggering, from advanced aerospace engineering to breakthroughs in biotechnology. Intellectual property theft not only undermines American companies, it also erodes the foundations of our future military and economic strength.

In many ways, this has been a one-sided economic war waged by China against the United States and the West more generally. If the United States cannot recognize the magnitude of this threat and combat it, it will risk giving up its leadership position in the technologies that will shape the next century.
Beijing has exploited the naivety of leaders in Washington and Brussels to weaponize their strengths (the liberal and globalized economic order) to its advantage in a judo-like manner. While direct military conflict is not inevitable, this trade war, waged through largely unconventional methods, will determine the outcome of any future military conflict between the United States and China.
The challenge for the United States in confronting this threat is that its traditionally structured intelligence, security, and judicial apparatuses are largely unsuited to combat this unique and modern threat.

How are America’s intelligence and security services approaching a partially-owned Chinese firm leveraging its business access to steal private secrets? What do U.S. federal prosecutors need to charge and convict those who engage in commercial espionage?
America stands at a crossroads. The traditional playbook, based on Cold War paradigms and focused on traditional espionage, is no longer sufficient in the face of this asymmetrical economic warfare. The United States must modernize its strategies and improve not only its intelligence capabilities but also forge stronger alliances with innovative companies and academic institutions. Defense measures must now extend beyond government agencies to the very heart of America’s entrepreneurial and academic fabric.

The United States should strengthen its defenses against intellectual property theft, as recommended by the Justice Department’s China Initiative, which has led to dozens of prosecutions for trade secret theft and economic espionage. An integrated approach that combines updated legislation, strong law enforcement, international collaboration and a revitalized commitment to research leadership offers the best path forward.
Finally, economic security within the administration needs to be elevated to the same priority as traditional national security; This dates back to the Cold War era, when the Soviet Union faced off as our arch-enemy in the world. Only then can America hope to secure its place at the top of the global technological hierarchy and defend its national security against the PRC/CCP, which intends to undermine America’s power through deceit and theft.
