US Supreme Court Refuses Deployment Of National Guard In Chicago | World News

The US Supreme Court on Tuesday (local time) refused to deploy the National Guard in Chicago over the objection of Illinois officials, citing doubts about the feasibility of such deployments in other cities, the New York Times reported.

The preliminary order prohibited the Trump administration from directing a state-based military force into the Chicago area, where immigration enforcement has triggered arrests and clashes between local and federal officials.

The court refused to give the president broad discretion in deploying the military in American cities.

The New York Times reported that at this stage of the case, the court said the Trump administration had not shown that the law in question “allowed the president to federalize the Guard by using inherent authority to protect federal personnel and property in Illinois.”

Three conservative justices, Clarence Thomas, Samuel A Alito Jr. and Neil M Gorsuch dissented.

Federal law allows the president to federalize the National Guard without permission from state officials in certain situations, including when there is “insurrection or danger of insurrection” against the government or when law enforcement is unable to enforce U.S. laws.

An appeals court in Washington had allowed troops to remain in the US capital while the case was pending, citing the city’s unique federal district status.

Meanwhile, the Pentagon decided in November to withdraw large numbers of out-of-state troops from Illinois and Oregon while keeping local troops active.

This comes against the backdrop of violence in Washington, including street protests against the National Guard and a targeted attack on November 26 in which two National Guard personnel were attacked, killing one and critically wounding the other.
