BJP says LoP Rahul Gandhi opposed SIR as he sided with ‘illegal infiltrators’

The Supreme Court on Wednesday upheld the Electoral Commission’s power to conduct Special Intensive Revision (SIR) of electoral rolls, saying the exercise “advances the constitutional imperatives of free and fair elections”.
In a post on X, BJP national spokesperson Pradeep Bhandari said: “Rahul Gandhi and Congress party exposed! Supreme Court declares SIR process legal and constitutional!”

“It is clear that Rahul Gandhi and the Congress (SIR) were opposed from the beginning because they were not on the side of Indian voters but on the side of illegal infiltrators,” Bhandari said. he said.

The BJP spokesperson also called opposition to the app an “anti-national act” and asked whether Gandhi would apologize “for defaming Indian democracy”.
“This was a truly anti-national Act,” he wrote. The Supreme Court was giving its verdict on a batch of petitions challenging the implementation of SIR in Bihar.
The plea alleged that the Election Commission does not have jurisdiction under Article 326 of the Constitution, the Representation of People Act, 1950 and the Regulations made thereunder for the wider conduct of SIR.
On January 29, the high court reserved its decision on the pleas, including the plea filed by an NGO of the Association for Democratic Reforms (ADR).

“The process, which may initially appear exclusionary, can be made constitutional through appropriate safeguards. We are satisfied that the impugned SIR application meets the requirements of proportionality,” a bench headed by Chief Justice Surya Kant said. he said.
The bench, which also included Justice Joymalya Bagchi, added that the survey panel cannot be said to have acted beyond its legal powers by using the SIR.
