BHP denied appeal for judgment over Brazil dam collapse

London’s Court of Appeal has ruled that BHP cannot appeal a UK ruling that it was responsible for the collapse of a dam in south-east Brazil in 2015.
In November, London’s High Court ruled that the Australian mining giant was legally liable for the collapse of the Fundao dam in the Marianas in south-east Brazil, owned and operated by the Samarco joint venture of BHP and Vale.
BHP’s application for leave to appeal the decision was rejected by the High Court in January and BHP appealed directly to the Court of Appeal, which refused permission on Wednesday.
