Case reopened after 46 years

A controversial confession

The appeal returned around Hernandez’s police interrogation in 2012. The police initially confessed to him before reading his rights. Hernandez was later given a legally necessary warning that his statements could be used against him in the court, and then he repeated his aunt entry at least twice.
At the hearing, the jury sent a note to the judge asking if he would ignore the two confessions recorded if he concluded that the first given before the Miranda warning. The judge replied, “No”. The court ordered the release of Hernandez to be released unless he took a new hearing in a “reasonable time”.
