Erika Kirk will be given option to leave Tyler Robinson hearing as investigators plan to share gruesome new Charlie murder evidence

As prosecutors begin presenting their evidence in the nation’s most closely watched assassination case, Erika Kirk will come face to face with the man accused of killing her husband.
Tyler Robinson’s preliminary hearing, scheduled for today through Friday in Provo, will not be a hearing. Instead, Judge Tony Graf Jr. will hear evidence to decide whether there is enough “reasonable doubt” that the 23-year-old Southern Utah man shot and killed the controversial founder of Turning Point USA last year to advance the death penalty case against him.
“There’s no doubt it exists,” Teneille Brown, a law professor and evidence expert at the University of Utah, told the Daily Mail.
Brown thinks Erika Kirk’s presence in the courtroom would distract from a hearing in which her testimony would not be taken.
‘There he presses for the cameras, putting himself front and center as if he’s in on the action. But that’s just between Utah State and Tyler Robinson. “He is not a party to this case,” he said.
The hearing will be published in the Daily Mail and will be broadcast live to the public.
Most anticipated was the testimony of Lance Twiggs, Robinson’s roommate and transgender lover; The accused gunman is believed to have confessed while on the run after Kirk was shot at Utah Valley University on Sept. 10. It is widely assumed that Robinson targeted Kirk, an outspoken opponent of LGBTQ rights, as a way of taking revenge for the kind of intolerance Twiggs and others experienced.
Rather than taking the witness stand in person, Twiggs will give a pre-recorded statement because he moved from Utah to Texas and was briefly under FBI protection. Robinson’s defense team lost its attempt to cross-examine him.
Prosecutors are also expected to present DNA evidence found on the rifle found at the scene, surveillance footage and electronic records, including material from Robinson’s cellphone and alleged confessions he made on Discord.

A note he apparently left for Twiggs on his keyboard reads: “I had the opportunity to take on Charlie Kirk and I’m going to take it.”
‘It was me at UVU yesterday. He sent Twiggs a text message after the incident, saying, “I’m sorry for all of this,” prosecutors said.
Prosecutors are likely to spend much of the trial detailing ballistic evidence.
A report by the Bureau of Alcohol, Tobacco, Firearms and Explosives showed that the bullet fragment recovered from Kirk’s body was returned ‘inconclusive’, although it found that the bullet casing matched the rifle found at the scene; This meant that investigators could neither confirm nor rule out that it came from that gun.
News reports, including the Daily Mail, suggested that the find did not include Robinson’s rifle.
“My expectation is that the state will want to clear up any misconceptions the public has about ballistics in this case,” said Paul Cassell, a former U.S. district judge in Utah and now a criminal law professor at the University of Utah, noting the difference between excluding Robinson’s rifle and not being able to reach a definitive conclusion.
In late June, one of the prosecutors, Christopher Ballard, was sanctioned for explaining this distinction to news reporters and saying, ‘We have sufficient evidence to show beyond a reasonable doubt that Tyler Robinson committed this murder.’ Judge Graf ruled that Ballard’s assertion that Robinson was guilty violated the gag order in the case.
His decision meant only a slap on the wrist, not the sanction Robinson’s defense team sought; That would take a possible death penalty off the table.
Robinson’s transgender girlfriend, Lance Twiggs, will give a pre-recorded statement because he moved from Utah to Texas and was briefly under FBI protection.
It is widely assumed that Robinson targeted Kirk, an outspoken opponent of LGBTQ rights, as a way of taking revenge for the intolerance experienced by Twiggs and others.
Prosecutors this week are also expected to present videos of Kirk’s killing, horrific images that Erika Kirk, Charlie’s parents, Kathryn and Robert Kirk and other loved ones attending the trial may have chosen to avoid by leaving the courtroom.
Security is expected to be extremely tight, and this applies not only to Robinson, who spent nearly ten months in solitary confinement. A source in Utah County told the Daily Mail that sheriff’s deputies will be closely guarding Erika Kirk, who for months has attracted hecklers who have lashed out at her and her late husband’s Turning Point conservative policies and mocked her mourning of his death.
Influencers including Shawn Ryan and Candace Owens criticized the widow for sharing on Instagram the moment she touched her husband’s body in the casket.
Conservative critics also took exception to Erika Kirk’s quick takeover as CEO and president of Turning Point USA. A leaked recording captured him giddily discussing rising product sales with band staff shortly after the elaborate, pyrotechnics-laden funeral, dubbing the ceremony the ‘event of the century’.
Legal experts expect few bombshells in court this week, assuming prosecutors summarize most of the evidence against Robinson in a probable cause affidavit in September.
“I anticipate the preliminary hearing will follow these allegations without any major surprises,” Cassell told us.
Robinson’s attorneys are currently expected to cross-examine state witnesses without calling their own witnesses or presenting any defense evidence.
‘They will want to keep their powder dry and their options open to testing.’
Prosecutors this week are also expected to introduce videos from Kirk’s Sept. 10 killing at Utah Valley University. Kirk was photographed at the event before the fatal shooting.
Erika Kirk was photographed embracing President Donald Trump at her husband’s memorial service last year.
Robinson’s defense team fought unsuccessfully to keep cameras out of the courtroom, arguing that hearsay testimony admitted at trial could taint future jurors. This type of hearsay evidence (witnesses who testify about what another person said rather than the direct source of the statements) would not be allowed later at Robinson’s trial.
Legal experts say it could take at least another year or two to actually try Robinson.
‘The defense wants extensions on absolutely everything,’ Brown told us.
Extensions are a common tactic in death penalty cases among lawyers seeking to extend their clients’ lives. If convicted, Robinson could face execution by firing squad.
The delays are likely due to Robinson’s defense team working on a ‘mitigation inquiry’ that collects facts about his life in case he is found guilty and his lawyers persuade the jury to spare him the death penalty and instead opt for a life sentence.
Their investigation will likely include creating a detailed life history of her, documenting her mental health and investigating any past abuse or trauma, investigating her family dynamics, relationships with friends and lovers, and showing how growing up online and playing video games may have damaged her brain.
Experts say a comprehensive mitigation study usually takes at least two years.
“To me, the story of Tyler Robinson is one that we don’t fully know yet,” said attorney John Blume, who has been defending capital cases since the mid-1980s.
‘It’s up to mitigation experts to fill these gaps.’
Conservative critics also took exception to Erika Kirk’s quick takeover as CEO and president of Turning Point USA.
Robinson’s parents, Matt and Amber Robinson, are traveling four hours south to St. Louis to attend this week’s hearing. They are expected to arrive from George, Utah.
Robinson’s parents, Matt and Amber Robinson, traveled four hours south to St. Louis to attend this week’s hearing, as they have at most hearings since September. They are expected to arrive from George, Utah. Our county source told us they’ll probably live as far away from Kirk’s family as possible.
Erika Kirk claimed to have forgiven Robinson.
“My husband wanted to save young men, just like the person who took his life,” she said at Charlie’s memorial service. ‘The answer to hate is not hate.’
During the conflict, Robinson was killed in St. He was a junior in the electrical apprenticeship program at Dixie Technical College in St. George and was studying to become an electrician.
In the ten months since his arrest, he has been the subject of extreme conspiracy theories.
Among them is that he was actually a Mossad agent assigned to shoot the conservative commentator on Israel’s behalf. Another claims to have carried out the attack on behalf of the French or Egyptian governments. Others claim that Robinson framed or acted as a decoy for Kirk’s real killer, who worked for the US deep state, as friends of Jeffrey Epstein, or – absurdly – for Erika Kirk herself.
David Robert Grimes, author of The Irrational Ape: Why We Fall for Disinformation, Conspiracy Theory and Propaganda, told the Daily Mail last month: “It’s fitting that the murder of Kirk, an interpreter of conspiracy theories, has led to this wave of conspiracies.”
A member of Kirk’s legal team said Robinson was ‘as concerned about the rumors about him as anyone else.’
‘Conspiracy scenarios, portrayals of Millennials as a kind of double agent provide a certain comic relief… and he doesn’t have much else to laugh about.’
