Karnataka HC Stays Govt Notification on Menstrual Leave

Bengaluru: The Karnataka High Court on Tuesday stayed the state government’s notification mandating provision of one day menstrual leave per month to working women.
In the communiqué dated November 9, a provision was made to provide one day of paid menstrual leave per month to female employees between the ages of 18-52 working in permanent, contracted and subcontracted jobs.
The stay was granted by a bench of Justice Jyoti M based on a petition filed by the Bangalore Hotels Association and Avirata AFL Connectivity Systems.
The petitioners alleged that the Karnataka government did not consult them before making such provisions.
Menstrual leave was for women working in all industries and establishments registered under the Factories Act, 1948, the Karnataka Shops and Trading Establishments Act, 1961, the Plantation Workers Act, 1951, the Beedi and Cigar Workers (Conditions of Employment) Act, 1966 and the Motor Transport Workers Act, 1961.
On December 2, the government had directed that female public employees in the state be given one day of menstrual leave every month with immediate effect.
