A grandmother attacked staff at Miller and Carter’s restaurant after arriving late to her party’s birthday dinner, hitting a waitress with her high heels and trying to punch the chef. Mary McGinley and her group turned up after going through their reservations at the Albert Dock branch at 9.45pm and were told the kitchen had already closed. The evening quickly turned violent, with staff forced to defend themselves using chairs and restraining one of the customers in a “bear hug”.
Despite the attack, the grandmother of two was spared an immediate prison sentence. Liverpool Crown Court heard on Tuesday that Angelo Muto and Maderson Roche-Jones were working at the city center restaurant on December 7, 2022, when McGinley, of White Moss Road South in Skelmersdale, arrived “there to celebrate his birthday” with his party at 10.15pm. The staff explained that the kitchen was closed and showed the group to the bar area instead.

Prosecutor Isabella Denn-White said the two men at the party could not prove they were over 18 and were refused alcohol. Liverpool Echo. The entire party was then asked to leave, but they continued to “hang out” outside the facility.
The “atmosphere then deteriorated”, with party members shouting at Mr Roche-Jones and some trying to force their way back into the restaurant. He grabbed a chair to defend himself as he backed through the building when patrons became aggressive and “raised their fists.”
McGinley then took off one of her high-heeled shoes and struck Mr Roche-Jones in the head. Chef Mr. Muto left the kitchen to intervene and tackled a male “ringleader” in a bear hug in an attempt to draw him out. The man responded by hitting the chef in the back of the head, causing him to fall to the ground.
At this point, McGinley attempted to punch Mr. Muto in the face multiple times, leaving a laceration, swelling and swelling over his right eye. Mr Muto told police he was “very stressed and shaken” by the attack and said: “No one has the right to attack me in my workplace. I am disgusted by their behaviour.”
Mr Roche-Jones also suffered swelling to the back of his head and bruises to his ribs. In a statement, Mr Roche-Jones said: “I was scared when the incident happened because I didn’t know what they would do. I’m worried something like this could happen again.”
The group left only after learning that the police had been called. McGinley was later tracked down according to his booking but missed a scheduled meeting with Merseyside Police, leading to his arrest a year later in December 2023. He had three previous convictions covering 11 offences, including theft and obstructing police.
McGinley, who has mental health problems and recently lost his family in Ireland, admitted assault occasioning actual bodily harm and assault by beating. The woman, who appeared in court wearing a black jacket and dark clothing with shoulder-length black hair, was given a six-month prison sentence suspended for 18 months.
Recorder Mark Ainsworth also imposed a rehabilitation activity requirement for up to 10 days and an electronically monitored three-month curfew from 9pm to 5am.
The second defendant, Charlie Doherty, previously pleaded guilty to a public order offense in connection with the same incident on his 18th birthday. The actor, now 21 and also from White Moss Road South, was granted conditional discharge from the same court in September 2024.
