Rahul Gandhi files revision petition in defamation case in Sultanpur

Gandhi’s lawyer Kashi Prasad Shukla said on Thursday that the complainant, Vijay Mishra, a local BJP member, had challenged the lower court’s order rejecting his plea to collect certain samples as evidence in the case.
The revision petition is currently pending in the court of Additional District Judge (ADJ)-V, he said.

Shukla said the sessions court fixed May 30 for hearing on the revision plea and also summoned relevant records in the matter.
Meanwhile, the next hearing of the main defamation case in the MP/MLA special court is scheduled to be held on June 17, he said.
The revision petition was filed against the lower court’s decision dated May 2, and the application filed by the complainant’s lawyer requesting collection of samples as evidence was rejected. Advocate Santosh Pandey had sought time from the court to file the revision petition, citing non-availability of a certified copy of the order.
The defamation case was filed by Vijay Mishra in October 2018.
In the case, Gandhi surrendered before the court on February 20, 2024, following which the special magistrate granted him bail against two sureties of Rs 25,000 each.

Gandhi appeared before the MP/MLA court on July 26, 2024 and recorded his statement, asserting his innocence and terming the case as a political conspiracy.
After the defense, the court instructed the complainant to present evidence, and then the witnesses on the subject were continuously interrogated.
Earlier, on February 20, Gandhi had also recorded his statement under Section 313 of the CrPC before the MP/MLA court.
The court asked him to provide explanations and evidence regarding his innocence. However, his lawyer Kashi Prasad Shukla did not submit any explanation or evidence to the court.
