The man who went viral for hurling racially charged slurs at Virginia gubernatorial candidate Winsome Earle-Sears at a college football game earlier this month later filed a police report claiming he was harassed after the incident went viral.

The Fairfax County Police Department confirmed to Fox News Digital that it was aware of the police report submitted and that the department’s threat assessment unit ultimately determined that the information provided did not meet the criteria for a criminal investigation.

The man in the viral video yelled at Republican Sears at a James Madison University football game earlier this month, “Go back to Haiti!” he shouted. “Traitor!”

Following the incident, Sears announced on social media that he was a Jamaican immigrant, not a Haitian immigrant.

“I thought Democrats were supposed to love everyone,” Sears joked at the time.

Local news reports reported that the man, identified as Scott Pogorelc of Centerville, Virginia, was also fired by his employer, a subsidiary of government contractor Lockheed Martin. A JMU football player with the same last name is a redshirt senior on the Dukes’ offensive line.

“We hold all of our employees and affiliates to the highest standards of integrity and professional conduct,” a Lockheed Martin spokesperson said in a statement, according to Fox 5 DC reporter Allison Papson. “Any conduct that violates our Code of Ethics will be fully investigated, and employees found to have violated it will be held accountable. Zeta Associates investigated the matter and this individual is no longer employed.”

Meanwhile, Pogorelc is also a Democratic Party donor, according to Federal Election Commission filings and the Virginia Public Access Project. Among those he donated to was Abigail Spanberger, the Democratic candidate for governor of Virginia who is running against Sears.

The situation involving Pogorelc was not the first time Sears has faced racially insensitive statements during its campaign in recent months. In August, a counterprotester speaking against transgender bathroom policies outside an Arlington County school board meeting held up a sign that read: “Hey Winsome, if trans people can’t share your bathroom, then Black people can’t share my water fountain.”

Following this incident, GOP Governor Glenn Youngkin, who is nearing the end of his term, criticized what he called “the hypocrisy of the liberal left.”

“Charm is so much bigger than this stupidity,” Youngkin wrote to X.

“This is wrong. [Winsome Earle-Sears] — and Virginia — deserve better,” Republican Attorney General Jason Miyares added in response to the sign. Miyares is running for re-election against Democratic nominee Jay Jones.
