Why have bankers had convictions quashed and what happens next?

Tom Hayes and Carlo Palombo overturned the ratio holder convictions

Tom Hayes and Carlo Palombo, two old city merchants, received the ratio -retention convictions transferred by the Supreme Court of England.

He was sentenced to imprisonment for manipulating the interest rates used for loans between banks dictating borrowing costs such as mortgages and automobile financing agreements.

So what’s the speed and what will happen next?

Why was Tom Hayes and Carlo Palombo thrown into jail?

Mr. Hayes and Mr. Palombo were prosecuted between 37 city traders for manipulating Libor and Euribor ratio criteria.

These were used to monitor cash borrowing costs between banks and to determine interest rates for millions of mortgages and commercial loans.

In part, with his actions, they were accused of adding to the 2008 financial crisis, when Mr. Hayes said, “they did not literally do nothing” after Mr. Hayes’ conviction.

Libor has now been stopped while the Euribor reform was made.

Mr. Hayes was accused of being a “bell manager” of an international fraud conspiracy to influence these rates in order to benefit the trade of banks.

In 2015, he became the first banker to be imprisoned for my ratio conflict and was initially sentenced to 14 years in prison, and then he was reduced to 11 years.

Mr. Palumbo was sentenced to four years of imprisonment in 2019.

What did they argue?

Mr. Hayes did not deny that he was trying to manipulate the Libor ratio when he was in Ubs and later in Citibank.

However, he said that there is a widespread application in the banks he worked and he was aware of what their superiors are doing.

He argued that a scapegoat was made for the actions of an industry.

Mr. Palombo, a former Barclays merchant, argued that it was a normal commercial practice.

How common were paid convictions?

From 2015 to 2019, 19 people were convicted of conspiracy for fraud in criminal cases on both sides of Atlantic and nine were imprisoned.

Since they served their time, he showed that the central bankers and government officials around the world, including a senior advisor at the Downing Street at that time, pressed very similar behaviors to imprisonment of banks like themselves – but on a much greater scale.

No central bank or government official was prosecuted.

Shortly after being released after being sentenced to full imprisonment, a US Court of Appeal decided that such behaviors were not a crime after all; to even take any rules.

The US Department of Justice canceled the charges against Tom Hayes, and the US courts later imposed similar convictions.

However, they remained as criminals convicted in the United Kingdom.

What did the Supreme Court rule?

After a 10 -year legal war, the Supreme Court decided that the hearings of Mr. Hayes and Mr. Palombo were unfair and disrupted their conviction.

In the UK, traders’ cases were prevented from reaching the Supreme Court by the Court of Appeal five times between 2015-2019.

However, the Supreme Court, Mr. Hayes and Mr. Palombo, at the end of Mr. Hayes, decided that the instructions given to the jury were wrong, and Mr. Palombo’s hearings were wrong, that is, his conviction was found to be insecure.

Serious fraud office, which sued against traders, said that it would not be for the public interest to seek a re -trial.

What will happen next?

Mr. Hayes said he could compensate for the money confiscated at a press conference. He said he would receive advice on claiming compensation.

“I have been living on a 24 -hour basis for the last ten years, because I haven’t planned any aspect of my life,” he said. He was prosecuted, then he was imprisoned, then with the license.

“Now suddenly, freedom and election view and what I can do is opened to me.”

Conservative Deputy David Davies said, “The Scape -Going exercise has taken place as a result of the dispute between banks and state institutions … And we do not finish our work with it – we will return to parliament in autumn.”

Mr. Hayes’s lawyer Karen Todner asked for a complete public investigation and justice system on convictions.

“Tom missed the years of shaping the loss of time and career and home with his son, his family.” He said. “When he never comes back”.

Mr. Hayes said that the accusation was “desperately uncertain” and that the case took too long to appeal.

“The dual role of the researcher and the prosecutor creates an important conflict of interest that creates abortions,” he said.

Carlo Palombo’s lawyer Ben Rose said other traders can now “confirm the wrong one.”
