FSSAI directs states to ensure removal of ORS from product labels and brand names

New Delhi [India]October 16 (ANI): The Food Safety and Standards Authority of India (FSSAI) has issued a directive to the Food Safety Commissioners of all States and Union Territories and all Central Licensing Authorities to ensure that all food business operators (FBOs) remove the combination of term “ORS” from their food products.
The organization stated that the directive would apply regardless of whether the term is used as a standalone word, used with any prefixes or suffixes, or forms part of a trademark in the product name.
“The use of the term ‘ORS’ in the trade name or name of any food product, whether fruit-based, still or ready-to-drink beverages – even when used in conjunction with a prefix or suffix, constitutes a breach of the provisions of the Food Safety and Standards Act 2006 and the regulations made thereunder,” the official statement said.
FSSAI has asked all authorities concerned to strictly comply with the labeling and advertising requirements prescribed under the Food Safety and Standards Act, 2006 and the regulations framing it.
Previous orders had permitted the use of the term “ORS” on food labels as part of a trademark that included a prefix or suffix in the product name, provided that the label included a warning stating “The product is NOT a WHO-recommended ORS formula.”
However, after further review, FSSAI clarified that any use of the term “ORS”, whether in a trademarked name or otherwise, for food products such as fruit-based, still or ready-made beverages is a violation of the provisions of the Food Safety and Standards Act.
According to the authority, such practices mislead consumers by using fake, deceptive, vague and inaccurate name or label statements.
FSSAI further stated that such products are considered misbranded and misleading, making them liable to penalty under Sections 52 and 53 of the Food Safety and Standards Act, 2006.
Authorities were also instructed to immediately ensure compliance by all food operators and take necessary measures against violations. (MOMENT)
